Agreement to Terms

By accessing or using PlayLabs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and PlayLabs regarding your use of the Service.

Description of Service

PlayLabs is a lesson planning application designed for Physical and Health Education (PHE) teachers. We provide tools for:

Creating lesson plans aligned with the BC K-5 PHE curriculum
Managing and organizing activities
Tracking curriculum coverage and identifying gaps
AI-powered lesson generation (paid plans)
Sharing lessons with colleagues

User Accounts

To use certain features of PlayLabs, you must create an account. When creating an account, you agree to:

Provide accurate and complete information
Maintain the confidentiality of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use Policy

You agree not to use PlayLabs to:

Create, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Share content inappropriate for a K-12 educational environment
Impersonate any person or entity
Interfere with or disrupt the Service or servers/networks connected to the Service
Attempt to gain unauthorized access to any portion of the Service
Use the Service for any commercial purpose not expressly permitted
Scrape, data mine, or use automated means to access the Service
Violate any applicable laws or regulations

User-Generated Content

Ownership

You retain all ownership rights to the content you create on PlayLabs, including lesson plans, custom activities, and other materials ("User Content").

License Grant

By creating or uploading User Content, you grant PlayLabs a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

Public Content

When you choose to make content public (such as sharing activities in the public library), you grant other users a license to view, use, and adapt that content for their own educational purposes.

Content Moderation

All user-generated content is subject to AI-powered moderation to ensure appropriateness for K-12 educational settings. We reserve the right to remove or disable access to any content that violates our guidelines without prior notice.

Intellectual Property

PlayLabs Property

The Service, including its original content, features, and functionality, is owned by PlayLabs and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

BC Curriculum Content

References to the BC PHE Curriculum are for educational purposes. The curriculum content and standards are owned by the Province of British Columbia Ministry of Education.

Subscription Terms

Plans

PlayLabs offers Free, Pro, and Max subscription tiers. Features and limitations for each tier are described on our pricing page.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect.

Refund Policy

Free trial: Pro tier includes a 14-day free trial. No credit card is required to start, and no charge occurs during the trial period. Your trial ends automatically unless you add a payment method.
Monthly subscriptions: No refunds for partial months. You retain access until the end of your billing period.
Annual subscriptions: Pro-rated refunds may be available within the first 30 days if you have not used AI generation features.

Limitation of Liability

To the maximum extent permitted by law, PlayLabs and its officers, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, or goodwill
Any damages resulting from your use or inability to use the Service
Any damages resulting from unauthorized access to or alteration of your data

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Service will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or reliability of any content obtained through the Service

Indemnification

You agree to indemnify, defend, and hold harmless PlayLabs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of another party

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved as follows:

Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at legal@playlabs.ca.
Mediation: If informal resolution fails, either party may initiate mediation through a mutually agreed mediator in Vancouver, BC.
Arbitration: If mediation fails, disputes shall be settled by binding arbitration in Vancouver, BC, in accordance with the rules of the British Columbia International Commercial Arbitration Centre.

Termination

By You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

By Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. We may also terminate accounts that have been inactive for an extended period.

Effect of Termination

Upon termination, you may request a copy of your data within 30 days. After this period, we may delete your data in accordance with our data retention policies.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlayLabs regarding your use of the Service and supersede any prior agreements.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the "Last updated" date at the top of this page
Notify you by email (for significant changes)
Display a notice within the application

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
